LUCIEBEAR TERMS OF SERVICE

Welcome to LucieBear. These Terms of Service (“Terms”) govern your access to and use of luciebear.com (the “Site”), including any purchases made through the Site. The Site is operated by LucieBear (“LucieBear,” “we,” “us,” or “our”).
By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1) ELIGIBILITY
You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By using the Site, you represent that you have the legal capacity to enter into these Terms.
2) CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Effective Date” above indicates when they were last updated. Your continued use of the Site after changes means you accept the updated Terms.
3) PRIVACY
Your use of the Site is also subject to our Privacy Policy. Please review it to understand how we collect, use, and share information.
4) PRODUCTS, PET SAFETY & NO VETERINARY ADVICE
LucieBear products are designed to support comfort and everyday recovery routines, but they are not a substitute for professional veterinary care.
IMPORTANT SAFETY NOTES:
• Always supervise your pet while using any product.
• Follow your veterinarian’s guidance for post-procedure recovery and pet health.
• Discontinue use if your pet shows irritation, distress, or unexpected symptoms.
You are responsible for choosing a product that is appropriate for your pet and for using it safely and as directed.
5) ORDERS, PRICING & PAYMENT
A) Order acceptance
Submitting an order is an offer to purchase. We may accept, reject, or cancel an order for any reason, including suspected fraud, inventory issues, or pricing errors.
B) Pricing and errors
We work hard to keep pricing accurate, but mistakes can happen. If a product is listed at an incorrect price, we may cancel the order and issue a refund.
C) Payments
We accept payment methods displayed at checkout. Payment processing is handled by third-party payment processors. We do not store full payment card numbers.
D) Taxes
Applicable taxes may be added at checkout where required.
6) SHIPPING, DELIVERY & RISK OF LOSS
Shipping times and fees (if any) are shown at checkout or in our Shipping Policy.
Once an order is handed off to the carrier, delivery timing is controlled by the carrier and may be impacted by weather, delays, or other events outside our control.
To the fullest extent permitted by law, title and risk of loss transfer to you upon our delivery of the package to the carrier.
7) RETURNS, REFUNDS & EXCHANGES
Returns, refunds, and exchanges are governed by our Returns & Refunds Policy, which is incorporated into these Terms by reference. Please review that policy before ordering.
8) PROMOTIONS, DISCOUNTS & GIFT CARDS
Promotions and discount codes:
• May be limited by time, product, quantity, or other conditions.
• Are not valid retroactively unless stated otherwise.
• May be canceled or modified at any time.
Gift cards (if offered):
• Are non-refundable except where required by law.
• Cannot be replaced if lost or stolen unless required by law.
9) ACCOUNT, COMMUNICATIONS & ELECTRONIC CONSENT
You may be able to create an account to make checkout easier. You’re responsible for maintaining the confidentiality of your login information and for all activity under your account.
By using the Site, you consent to receive communications from us electronically (such as email confirmations, shipping updates, and customer support responses).
10) USER CONTENT (REVIEWS, PHOTOS, COMMENTS)
If you submit reviews, photos, videos, comments, or other content (“User Content”), you represent that:
• You own the content or have permission to share it, and
• It does not violate any law or anyone’s rights.
By submitting User Content, you grant LucieBear a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, display, modify, and distribute that User Content for business purposes (including marketing), without compensation to you.
We may remove User Content at any time for any reason.
11) INTELLECTUAL PROPERTY
All content on the Site—including text, images, graphics, logos, product names, and design—is owned by LucieBear or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit Site content without our prior written permission.
12) PROHIBITED USES
You agree not to:
• Use the Site for unlawful purposes
• Attempt to hack, disrupt, or interfere with Site security or functionality
• Scrape, harvest, or misuse data from the Site
• Use the Site to transmit malware or harmful code
• Engage in fraudulent purchases, chargeback abuse, or other deceptive practices
13) THIRD-PARTY LINKS & SERVICES
The Site may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices.
14) DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
15) LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW:
• LUCIEBEAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
• LUCIEBEAR’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO LUCIEBEAR FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
16) INDEMNIFICATION
You agree to defend, indemnify, and hold harmless LucieBear and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, violation of these Terms, misuse of products, or infringement of any rights of another party.
17) FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier disruptions, labor shortages, supply issues, or network/technology outages.
18) GOVERNING LAW & VENUE
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
Unless prohibited by law, any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
19) SEVERABILITY
If any part of these Terms is found unlawful, void, or unenforceable, the remaining provisions will remain in effect.
20) ENTIRE AGREEMENT
These Terms, along with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and LucieBear regarding your use of the Site and purchases made through it.
